This is the Ordinance which rescinded investigations of Citizens Complaints.It was signed by Joseph McKire, Mayor and Shirley Heath, Town Clerk. Mr. McKire did not believe in the redress of grievances nor did the council including Walter McKenzie and Ralph Hardwick. As such, it violated Article 1 of the Declarations of Rights, Section 5 of the U.S. Constitution, under the Right to Assemble, stating: The people shall have the right peaceably to assemble, to instruct their representatives and to petition for redress of grievances.
Mr. Koberlein tried to provide these rights and a system in which to handle complaints but such was ignored by the councilors Rhett Bullard, Tonja Brown, Willie Jefferson, and Walter McKenzie. Our Current Mayor Spencer Lofton discusses complaints outside of the sunshine with whom he wishes and will not address them in public meetings, even if one uses their five minutes to discuss the complaint. ORDINANCE NO. 01-04
AN ORDINANCE RESCINDING ORDINANCE NO. 99-20 RELATING TO THE INVESTIGATION OF CITIZEN COMPLAINTS PROVING A SEVERABILITY CLAUSE: PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town of White Springs, Florida adopted Ordinance No 99-20 relating to the investigation and disposition of citizen complaings; and
WHEREAS, The Town of White Springs, Florida has determined that the implementation of Ordinance 99-20 is no longer in the best interests of the citizens of the Town of White Springs, Florida, and
WHEREAS, the Town of White Springs Florida has determined that it is in the best interests of the citizens of the Town of White Springs, Florida to rescind Ordinance 99-20.
NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF WHITE SPRINGS, FLORIDA THAT;
SECTION 1, REPEAL OF PRIOR INCONSISTENT ORDINANCES:
All ordinances in conflict with any of the provisions of this Ordinance are hereby repealed.
SECTION 2 AUTHORITY:
This Ordinance is enacted for the purpose of rescinding Ordinance 99-20 regarding the investigation and disposition of citizen complaints as the Town Council has determined that said Ordinance is no longer necessary for the welfare and benefit of the citizens of The Town of White Springs, Florida.
SECTION 4, EFFECTIVE DATE:
This Ordinance shall take effect immediately upon its adoption by the Town of White Springs Florida in accordance with the provision of Florida Statutes Passed upon first reading the 2nd day of October 2001. Passed and Adopted upon Second and Final Reading this 16th day of October, 2001.
