AN ORDINANCE OF THE TOWN OF WHITE SPRINGS FLORIDA AMENDING THE CHARTER OF THE TOWN OF WHITE SPRINGS, FLORIDA, BY AMENDING SECTION 5.06 TO PROVIDE THAT THE TOWN OF WHITE SPRINGS, FLORIDA HAS THE RESPONSIBILITY FOR PROVIDING FIRE PROTECTION SERVICES WHETHER BY AND THROUGH A WHITE SPRINGS VOLUNTEER FIRE DEPARTMENT OR BY AND THROUGH AN APPROPRIATE CONTRACTUAL RELATIONSHIP WITH A THIRD PARTY FIRE AGENCY. THE TOWN COUNCIL SHALL HAVE THE SOLE DISCRETION IN DETERMINING THE MANNER FOR PROVIDING FIRE PROTECTION SERVICES FOR THE SAFETY AND WELL BEING OF THE CITIZENS OF WHITE SPRINGS FLORIDA. NOTHING HEREIN SHALL PREVENT THE WHITE SPRINGS VOLUNTEER FIRE DEPARTMENT FROM ASSISTING NEIGHBORING AGENCIES AS THE NEED ARISES; BY AMENDING SECTION 7.02 OF THE TOWN CHARTER TO PROVIDE THAT THE TOWN COUNCIL SHALL DETERMINE THE TERMS AND MANNER OF SALES AND DISTRIBUTION OR OTHER DISPOSITION OF ANY PROPOSED BOND ISSUANCES; AND PROVIDING AN EFFECTIVE DATE.
Section 5.06 Fire Protection Services
The Town of White Springs Florida has the responsibility for providing fire protection services whether by and through a White Springs Volunteer Fire Department or by and through an appropriate contractual relationship with a third party fire agency. The Town Council shall have the sole discretion in determining the manner for providing fire protection services for the safety and well being of the citizens of White Springs Florida. Nothing herein shall prevent the White Springs Volunteer Fire Department from assisting neighboring agencies as the need arises.
So technically, the White Springs Council had the discretionary right solely in determining the manner for providing fire protection services for the safety and well being of the citizens of White Springs, Florida.
It would have been more logical to have hired Kevin Pittman and the Brotherhood as third party fire agency than having hired Tommie Jones an inexperienced Town Manager and Consultant, the latter of which does not allow him to hire and fire or make decision. Nor did we have to wait until Stacy Tebo gave her notice.
Instead every council member was afraid to go ahead at the time making us wait for fire protection under Kevin Pittman for almost one year and one-half of Helen’s term as Mayor. And we are lucky that Kevin Pittman was willing and able to come back as was Tom Brazil and the balance of the firefighters.
The problem with the firing of Prueter is that Tommie did not have the right no matter what our attorney said in her agreements. He technically could not be a manager only a consultant without decision making capabilities. Beverly Brazil should have been the Town Manager and Tommie could have been a consultant assisting Ms. Brazil (But Ms. Brazil probably didn’t need a consultant except for additional computer work which she does fine with as it is.)
And furthermore, the fact that Walter McKenzie attended the meeting was probably good because McKenzie had the power in this instance in accordance with the ordinance since as a council member for a decision already made, he had the sole discretion. But understand, Tommie made a huge mistake in calling Mr. Preuter when he was on military drill and telling him to come back to fight a fire because of the protections of those in the military reserves, application or not.
There would have had to have been an application with Hamilton County and obviously if there was none at White Springs, he could argue that why did he have to fill out an application with the Town as a volunteer when Tommie Jones as a consultant acting as a Town Manager which is not lawful, did not have to fill one out. His word over the telephone should have been sufficient under White Springs precedence.
