Town of White Springs Complaint Hearing Procedure August 4, 2016
When presiding over formal Complaints the Council is acting as the judges and jury. The Council is directed to read the allegations of the Complaint, consider all evidence in any form presented by the Complainant and then afford the Respondent (accused) an opportunity to defend himself or herself which includes the opportunity to present evidence in any form. The Respondent should not be required to respond.
After receiving all the evidence presented to it the Council should make a finding as to whether the evidence supports the allegation(s) of the Complaint and whether such supported allegations rise to the level of a violation of local law or policy. If the evidence does not support the allegation(s), then Council should dismiss the Complaint. If the evidence does support the allegation(s), then the Council should find that the Respondent has committed a violation, in which case the Council should refer to the personnel policy for disciplinary measures.
SURE BLOWS THE HELL OUT OF MEAGAN’S STATEMENT THAT INVESTIGATIONS OF CITIZEN COMPLAINTS IS NOT A QUASI JUDICIAL FUNCTION. SHE LIED TO PROTECT MAYOR MILLER AND TOMMIE JONES. I NEVER THOUGHT I’ SAY T HIS BUT KOBERLEIN DID GOOD. IT ALSO CONFIRMS MY SUMMARY OF THIS MEMO RINTED PREVIOUSLY.
