Times Publishing Co. vs. Williams verified by Neu vs. Miami Herald says that a citizen is Allowed to understand the thinking of his public officials on official matters. But the Town Council is continuing to hide behind their public offices thereby keeping the corruption in the Town of White Springs on- going. Isn’t the word of the 2nd DCA and the Supreme Court good enough for you guys.
I FAIL TO UNDERSTAND WHY THE COUNCIL MEMBERS ARE DEAD SET AGAINST TELLING THE CITIZENS WHAT THEY ARE THINKING ON PUBLIC MATTERS. I KNOW THAT THE TOWN ATTORNEY POO-POOS THE CASE LAW WHICH TO THIS LAYMAN IS REAL CLEAR BUT NOTHING PREVENTS THE COUNCIL FROM PASSING AN ORDINANCE THAT SAYS THE COUNCIL MEMBERS AND TOWN STAFF HAVE AN OBLIGATION TO THE CITIZENS TO EXPLAIN THEIR THOUGHTS ON MATTERS OF PUBLIC BUSINESS. WE DON’T NEED A LAWSUIT TO ESTABLISH AN ORDANIANCE. WHAT IS WRONG WITH THAT POLICY I WANT TO KNOW?
“It is the how and the why officials decided to so act which interests the public, not merely the final decision.” As the court recognized in Times Publishing Company v. Williams, 222 So. 2d 470, 473 (Fla. 2d DCA 1969), disapproved in part on other grounds, Neu v. Miami Herald Publishing Company, 462 So. 2d 821 (Fla. 1985):
“Every thought, as well as every affirmative act, of a public official as it relates to and is within the scope of his official duties, is a matter of public concern; and it is the entire decision-making process that the legislature intended to affect by the enactment of the statute before us.”
The Court decisions DO NOT PROHIBIT THE ANSWERING OF QUESTIONS, THEY ONLY SAY THAT THERE IS NO REQUIREMENT THAT THE PUBLIC SERVANTS DO THAT. I SAY MAKE AN ORDINANCE OR RESOLUTION THAT SAYS THAT PUBLIC SERVANTS (THE COUNCIL AND THE STAFF) ARE REQUIRED TO ANSWER QUESTIONS ON THE THOUGHT PROCESSES THEY USED TO MAKE A DECISION NOT MERELY TELLING US THE RESULTS OF THEIR DECISION MAKING.
WHAT WOULD BE WRONG WITH THAT MEAGAN, HELEN, WALTER AND TOM? I CONTEND THAT WE SHOULD HAVE A STRICTER INTERPRETATION OF THE COURT’S OPINIION AS WAS EXPRESSED BY SPENCER AND TONJA TONIGHT. ANSWER THE QUESTION PLEASE. DON’T HIDE BEHIND YOUR PUBLIC OFFICE AND YOUR REQUIREMENT TO SERVE THE PEOPLE.
