Why don’t you just file suit against the Town again if you are right and everyone else is wrong that the Town cannot hire a contract employee.

Not for the Town Manager position because he has to make decisions for the town, Can Meagan make decisions for the town without council approval. NO SHE CAN”T. This article is not about a suit but the fact that the DECISION to hire a “Consultant” was done OUTSIDE of the SUNSHINE. In other words, there were no minutes because it was decided before he was hired at the 8:00 am meeting. At that meeting an amount was stated by Mayor Miller and his hours, etc. However, no where was it stated he was a consultant; only a Town Manager. Thereafter, at the regular scheduled meeting, I believe in November, because there were complaints about his background, Attorney Meagan Logan stated that because he was a “Consultant” no application or background check was necessary. As such, it was the first any of us heard he was a “Consultant” and the contract was for an interim Town Manager with no mention of “Consultant” Per the IRS and rules relating to Independent Contractors / “Consultants by Florida Statute as well, a Town Manager position is usual to a municipality and as such, the Town Manager portion of his consulting should be as an “Employee” of the town with or without benefits per the contract whereas, and we do not know what he is a “consultant of” computers? that would fall under the jurisdiction and definitions of “Consultant”. The Town has the right to have a “Consultant” hired but not as a “Town Manager” where his wage is determined, where the Town has full control of what he does; where he offices and where he utilizes the tools provided by the Town, etc. If the business is usual to the Municipality, that portion of the business does not allow him to be a “consultant”.
