Today her reply brief is due in Federal Court. She’s had a month to turn it in but like everything else she does, she’s waited for the last minute. For her sake I hope she follows the rules of Appellate Briefs and tell how the Trial Judge made an error or used the wrong law. She certainly didn’t do that on her Initial Brief. 90% of Appellate Actions go against the Appellant (Stacy) and when the Trial Court made a decision without a trial the number climbs to over 95%. Telling the Court that their Judge made a mistake is not cool. We tried it in our legal case against the Town and it didn’t work our for us either.
Assuming Stacy’s Attorney gets the Reply Brief in today a whole transcript will be on the Blog tonight. It may be long and boring but we’ll see.
