Firefighter Names on the current Roster

Obviously no one at the Town nor our Town attorney may interpret the law and your below paragraph stipulates it a DPPA restricts public access to your social security number, driver license or identification card number, name, address, telephone number and medical or disability information, contained in your motor vehicle and driver license records. Additionally, emergency contact information and email addresses are restricted pursuant to Section 119.0712(2), Florida Statutes.
A prudent man would read this and by the coma therein the “Name” depicts that one cannot secure such information CONTAINED IN YOUR MOTOR VEHICLE AND DRIVER’S LICENSE RECORDS. Likewise any personal information, email addresses are restricted by Florida Statute. But here is the Florida Statute and Since Florida has their own set of restrictive laws, the State Trumps the Federal Law, even though this federal law does not prohibit the “NAMES” ONLY BEING SHOWN ON A ROSTER. I am sorry our Town attorney has not studied Civil Law and cannot read statutes.
But here is the Statute Pam under 119.07.
The home addresses, telephone numbers, dates of birth, and photographs of current or former firefighters certified in compliance with s. 633.408; the names, home addresses, telephone numbers, photographs, dates of birth, and places of employment of the spouses and children of such firefighters; and the names and locations of schools and day care facilities attended by the children of such firefighters are exempt from s. 119.07(1) and s. 24(a), Art. I of the State Constitution. This sub-subparagraph is subject to the Open Government Sunset Review Act in accordance with s. 119.15, and shall stand repealed on October 2, 2022, unless reviewed and saved from repeal through reenactment by the Legislature
So even though we previously were provided rosters of our firefighters’ NAMES even though such information was fictitious after Kevin Pittman resigned, there is no law saying the NAMES of Firefighters may not be provided only that the names, etal of their spouses, or where they are employed or the names of their children and the schools the children are attending may not be given.
Public records laws have been enacted in all 50 states and by the federal government. The federal public records law, known as the Freedom of Information Act, applies to federal agencies, while state public records laws govern state and local agencies. So accordingly, State Law trumps Federal Law. Where a State like Florida does not have a specific law like in the case of not having State overtime Laws, the employees are governed by Federal law or FLSA.
So Pam, obviously the statute cannot be read as to its intent by you or your Town Manager and it is obvious Town Attorney cannot read statutes, just like she could not read the Statute on the Local Option Fuel Tax problem we have for which she concurred with the CPA. To secure my masters, I had to read Civil/Business and Insurance Law books to pass the essay exam and I aced it because Law is written in the English language which is easily understood.
As a result although Joe went to the First Amendment foundation for a response, the information I provided to you is accurate so therefore PLEASE PROVIDE JOE GRIFFIN WITH THE LATEST FIREFIGHTER ROSTER, LIKE YOU HAVE IN THE PAST, LISTING EACH OF THE FIREFIGHTER’S NAME AND INCLUDING INFORMATION AS TO WHETHER THEY HAVE CERTIFICATIONS FOR FIREFIGHTER i OR FIREFIGHTER ii CERTIFICATES (LIKE YOU HAVE DONE WHEN PITTMAN WAS CHIEF). We are not asking for any personal information of the Firefighters, nor of their spouses or children and a NAME AND THEIR CERTIFICATION IS NOT EXEMPTED NO MATTER WHAT YOUR ATTORNEY HAS STATED. IF YOU AND STACY TEBO CAN READ, WE ASK THAT YOU READ THE INFORMATION OF THE STATE UNDER CHAPTER 119.07….
If this non-personal information is not provided by the volunteers who supposedly are volunteers for the Town of White Springs, then it is obvious the Staff of White Springs does not believe in Transparency and are hiding the fact that we do not have a viable Fire Department, which I had previously reported to the Hamilton County Board of Commissioners to which your current chief said “Good Speech). In other words Transparency by the Feds was an issue after Watergate and subsequently all State Laws apply except for such laws which have not been enacted such as Labor and Overtime Laws, where Federal Law Prevails.
If you have any questions, please feel free to contact either Joe or I. And wasting you money on an attorney’s interpretation who is unable to read a statute makes no common sense. PLEASE SEND THE ROSTER OF NAMES INCLUDING EACH CERTIFICATION WHICH APPLIES TO EACH INDIVIDUAL ON THE ROSTER AS SOON AS POSSIBLE
